These terms of use apply to the use of the Compassana app offered by Bluespace Ventures AG (‘Bluespace’) and to all interactions and legal transactions concluded via the Compassana health platform (‘Services’).
The use of Compassana is reserved for natural persons residing in Switzerland who are a minimum of 16 years old and requires the creation of a Compassana user account.
We process your personal data in connection with the use of the Compassana app and the services offered via the Compassana health platform in accordance with our privacy policy. This explains how we handle personal data and explains what personal data is processed for what purpose, whether and how it is passed on and the rights that data subjects have with regard to their personal data. By registering for the Compassana platform and using it, you accept these terms of use and the associated processing of your personal data in accordance with the privacy policy. You may not use the Compassana app without accepting these terms of use and the privacy policy.
Commercial use of Compassana is prohibited, with the exception of healthcare professionals who provide services to you via Compassana and who may access your data for this purpose.
These terms of use and the privacy policy are available for you to view at any time after you have created a user account in the Compassana app.
Compassana is a platform provided by Bluespace, with applications and services that allow you to create a user account and then use that to process and store your personal health data and other personal data (e.g. information, documents) in one location in electronic format and also to share it with the healthcare professionals you select.
In addition, you can use other services via the platform, such as requesting medical data from healthcare providers or booking consultation times with healthcare providers and communicating with them.
Bluespace uses the most modern digital technology to identify you as a user so that as a result you are able to access your data and the available services at any time in a transparent manner and so that you have them available to you independently.
In this process, Bluespace acts purely as a provider of the platform and as an intermediary for the external services incorporated in the platform. Under no circumstances is Bluespace to be considered the provider of the offers and services available via the platform. The usage contract for each of these offers and services is concluded exclusively between you and the respective third-party provider; the terms of use of each corresponding provider will apply.
The platform is not a medical device, and its use is in no way intended as a substitute for in-person medical consultation and treatment. The information on the platform should not be used to create independent diagnoses or for the selection, application, alteration or ending of treatments for illnesses. If you have health issues, it is recommended that you visit a specialist. Bluespace will not be held liable for the services provided via this platform.
In order to access the Compassana platform, you must install the Compassana smartphone app on your mobile phone and agree to the terms of use of the manufacturer of the smartphone operating system in question, as well as the terms of use for the associated notification functions. The Compassana app is available either for Apple iOS or for Google Android in the relevant app store.
You are responsible for your smartphone or other end device. In your own interest, therefore, please ensure that unauthorised access to your device does not result in data being improperly transferred or stolen by third parties.
In order to make it possible to establish the level of trust required with regard to personal health information and to enable the best possible level of data privacy, the use of Compassana requires the identification of the user by means of a ‘know your customer’ process. You cannot use the Compassana app without this service provided by PXL Vision.
You are prohibited from using Compassana for any purpose other than those intended, behaving abusively and/or using Compassana services to store, distribute or make available illegal content of any kind.
You undertake, in your own interest, to ensure that the information and documents that you provide when creating the Compassana user account and the data that you enter and save in your account are correct and complete.
You are responsible for incorrect, incomplete or outdated information (e.g. in the case of these being accessed by a medical service provider).
You are also responsible for what data you save in your personal archive and for ensuring that you have the necessary consent and rights with regard to data from third parties. You can alter, add to, or delete this data at any time.
If you collect data from other people (e.g. family members) or if you process such data, whether in your own archive or in the health records of third parties, you must have obtained the express consent of all data subjects in advance, insofar as you are not legally entitled to perform such actions.
You must keep the access data confidential and will pass them on to third parties. You will be obliged to choose a secure password and to change it if there is a suspicion that it has been compromised. Bluespace rejects any liability for the consequences of the access data becoming known.
Bluespace reserves the right to block your access to the platform at any time and without prior notice if there is a suspicion that you are violating the provisions above.
The use of the Compassana app is free of charge.
You have the option to use fee-paying services in accordance with their terms of use or to request and commission the provision of fee-paying medical services.
In these cases, the contract is not entered into with Bluespace, but rather with the service provider in question.
Please note that in particular even the exchanging of information with your preferred medical specialists may be subject to a fee when placing an order. Please clarify this directly with them. Bluespace is not able to accept any liability or assume any costs in this respect.
All intellectual property rights and other rights to Compassana, such as trademarks, names, titles, logos, images, designs, texts and other materials are owned exclusively by Bluespace or a contractual partner of Bluespace. No rights (rights of use, intellectual property rights, etc.) are acquired by accessing, downloading or copying content from the platform. Reproducing (in whole or in part), transmitting (electronically or by any other means), modifying, linking to or using the platform for any public or commercial purpose is prohibited without Bluespace’s prior written consent.
Bluespace makes the Compassana app available to you without any assurance of certain properties and without any promise or guarantee regarding independent use. We hope that it will enable you to optimise and simplify your personal health management, but we cannot guarantee or assure this.
Accordingly, downloading, installing and using the Compassana app is performed at your own risk.
The information published on Compassana can be changed at any time and without prior notice. Bluespace assumes no liability (either express or implied) for the information published on Compassana being correct, complete and up to date.
The services and information on Compassana are offered as part of Bluespace’s technical, operational and financial options.
If possible, we will inform you in advance of planned maintenance measures that may restrict operations; however, we cannot guarantee uninterrupted or error-free operation of the platform.
Bluespace reserves the right to discontinue and/or change any offers available from Compassana at any time.
Bluespace accepts no liability (including liability for its auxiliary persons, employees, suppliers and subcontractors) for all claims arising from or in connection with the use of Compassana to the maximum extent permitted by law, in particular for damages due to transmission errors, technical defects, interruptions or disruptions.
Bluespace will not be held liable for claims arising from or in connection with each contract between the user and the third-party in question provider mediated via the platform; in particular, Bluespace will not be held liable for any damages arising in connection with the services provided by the third party.
Bluespace will not be held liable in any way for the availability of a service or for the creation of a communication mediated by it, for any consequential costs resulting from the use of a service (such as the creation of a treatment order) or for availability being delayed or restricted or for there being no availability.
If there are links to Compassana on third-party websites, Bluespace will in no way be held liable for the correctness, completeness and legality of the content of such websites.
Bluespace is entitled to block or delete your Compassana user account at any time without prior notice and without stating a reason for doing so.
You are also entitled to delete or have your Compassana user account deleted at any time and without prior notice.
The internet is an open network accessible to everyone and is therefore generally not considered a secure environment. Although the individual data packets are transmitted strictly in encrypted form, this may not apply to the sender and the recipient. The operator will not be held liable for the security of data during transmission via the internet.
You agree to receive service-related notifications that are important and helpful with regard to the use and operation of Compassana’s service: This includes, for example, notifications in which Bluespace provides notification regarding requests to exchange information with other platform participants, service-related and operational conditions, product innovations relevant to operation and security incidents.
These service-related notifications are distributed on an event-related basis via the notification functions (‘push functions’) of the Compassana app or by e-mail and, depending on the situation, can be addressed to individuals, a group of affected users or to all users. They are deemed to have been delivered when they are provided by Bluespace, although you can control the actual retrieval of these notifications in the notification settings on your smartphone or using the instructions in the e-mails.
You agree to receive further relevant information that may be of interest to you from Bluespace and its service partners through the newsletter. This information is distributed in an e-mail newsletter. This subscription to the newsletter can be cancelled at any time. Information on this can be found in each newsletter.
Bluespace reserves the right to adjust these terms of use at any time without stating any reason. In particular, we adapt them with each new release so that all new services are taken into account properly. Unless you object, you are deemed to have accepted these changes. Otherwise, Bluespace can terminate the agreement extraordinarily. All other changes to these terms of use or agreements deviating from them must be in written form.
With regard to complaints by users, either their place of residence or the city of Zurich will be the place of jurisdiction. In all other cases, the city of Zurich will be the exclusive place of jurisdiction.
These terms of use are subject to Swiss law.
The remaining provisions will remain unaffected if individual provisions are ineffective.
